The Lemon Law varies by state. The main purpose of the Pennsylvania Lemon Law is to provide vehicle owners of both cars and passenger trucks, with a no cost method of forcing vehicle makers to repurchase defective vehicles. If the PA Lemon Law is found to have been violated, the manufacturer must buy the consumer's vehicle back and pay all of their attorney's fees. The PA New Car Lemon law was enacted to protect
consumers who purchase or lease, and register a new vehicle
in the state of Pennsylvania. In Pennsylvania, a car may
qualify as a lemon if a defect or condition that
substantially impairs the use, value or safety of the
vehicle is reported to a dealer within the first 12 months
or 12,000 miles, whichever comes first, and the vehicle
requires more than three repair attempts to repair the
defect or the vehicle is out of service for thirty days or
more for any number of defects or conditions. Only the first
report of a defect or condition must be reported within the
first 12 months or 12,000 miles. The subsequent repair
attempts or days out of service may occur after the first
year.
If the defect can not be repaired in a reasonable number of
repair attempts, you may be eligible for a replacement
vehicle or the refund of the purchase price, less a limited
allowance for use. You may request an arbitration of your
case through the manufacturer’s dispute settlement program
if one exist or you may bring a civil action.
