hat is the Lemon Law?
The Lemon Law varies by state. The main purpose of the Pennsylvania and New Jersey Lemon Laws are to provide car owners with a no cost method of forcing vehicle makers to repurchase defective vehicles. If the Lemon Law is found to have been violated, the manufacturer must buy the consumer's vehicle back and pay all of their attorney's fees. At Power & Associates, each of our cases are taken on a no-cost, no-fee basis. We bear the fees and the court costs, win or lose.
hat are Breach of Warranty Laws?
Breach of Warranty Laws provide protection for consumers who experience recurrent problems with a vehicle still covered by the manufacturer's warranty but no longer covered by the Lemon Law. A breach of warranty claim can result in a repurchase or a cash settlement with the consumer maintaining possession of the vehicle. Like the Lemon Laws, the breach of warranty statutes allow for free legal representation to consumers.
hat vehicles are covered under the Lemon Law?
Both the Pennsylvania and New Jersey Lemon Laws cover purchased and leased vehicles. New Jersey's Lemon Law also covers motorcycles while Pennsylvania's breach of warranty statutes cover motorcycles. Vehicles purchased and used are not covered under the Pennsylvania Lemon Law but may be covered under the New Jersey Lemon Law. However, used vehicles are covered by the breach of warranty statutes as long as the problems begin while the warranty was in effect.
